Privacy Policy

1. Introduction

1.1. Users of the Platform and any of its features shall be bound by this Privacy Policy and all its subsequently modified versions.

1.2. Capitalised terms used but not defined in this “Privacy Policy” shall have the meanings ascribed to them in the Entity’s Terms of Service (the “Terms of Service”), the latest version of which is available at [insert URL].

1.3. “Personal Information” is information through which Users can be directly or indirectly identified, such as their name, e-mail address, information made available on social media, telephone number, password, Services purchased, products purchased, etc. (provided that the Entity can connect them to the Users’ email address). In this regard, this Privacy Policy describes what information the Entity collects, the purpose, use and disclosure of such information and the reasonable security practices and procedures followed by the Entity in respect of Personal Information. This Privacy Policy also explains the Users’ rights regarding their Personal Information.

1.5. By using or accessing the Platform, Users agree to the terms and conditions of this Privacy Policy. The Users also expressly consent to the Entity’s use and disclosure of their Personal Information in any manner as described in this Privacy Policy. At any time, the Users have the right to not provide the Entity with certain information, or withdraw their consent with respect to the collection, processing or disclosure of the same. Please note however, that in such cases, the Entity reserves the right to limit the Services offered to such Users, or refuse the provision of such Services in their entirety.

2. Collection of Personal Information

2.1. The Entity receives Personal Information from the Users in the following cases:

2.1.1. Registering an Account: The Entity stores the information that the Users provide to the Entity when Users create an account on the Platform (including email address, phone number, name, password, address and additional information Users may voluntarily provide to the Entity.

2.1.2. Transactions: The Entity collects certain information while providing the Services to verify Users’ identity, date and type of Service request.

2.1.3. Reviews: The Entity collects information pertaining to the Users name, email address and any other media, as provided by the Users during the process of providing reviews on products listed on the Platform.

2.1.4. Use of the Platform: The Entity stores details of any pictures/materials shared by Users for publication on social media and details pertaining to any promotion sponsored by the Entity. Additionally, the Entity collects and stores details pertaining to User visits to the Platform (such as pages visited) and User interactions with any e-mails that the Entity sends to such Users. 2.2. Cookies:

2.2.1. The Entity uses cookies and other technology like pixel tags for purposes described below. Cookies are small files which are sent from the Platform and then stored on Users’ devices. Pixel tags, also called web beacons are clear image (i.e. non-visible) files that may be placed on the Platform which request information from User devices (collectively, “Cookies”).

2.2.2. The Entity sometimes collect anonymous information from visits to the Platform and use this data to analyse trends and statistics and to help provide better customer service. This anonymous information is sometimes known as “clickstream data”.

2.2.3. Cookies may be set in User devices when the Users access the Platform or may be set when Users visit third party websites or Platforms.

2.2.4. Users are free to suitably modify the Platform settings if the Users do not wish to accept cookies, but please note that changing such settings in the Platform may affect User experience therein and the Entity’s ability to effectively deliver the Services.

2.3. Types of Cookies

2.3.1. The Entity uses Cookies for different purposes, which can be categorised as follows:

  • Required Cookies: These Cookies enable the Users to navigate the Platform and use its features, such as accessing secure areas of the Platform and using the Entity Services. Each time the User logs into the Services, a Cookie containing an encrypted, unique identifier tied to the User’s account is placed on User’s browser. These Cookies allow the Entity to uniquely identify the User when using the Platform and to process the online transactions and requests.

  • Functional Cookies: These Cookies are required for the Platform to function. They include, for example, Cookies that enable Users to log in. They may also enable the Entity to recognise Users when Users return to the Platform and store information about User preferences, so they allow the Entity to customise the Platform according to individual preferences (such as the language chosen by the Users, changes made to text size and fonts, etc.).   • Performance Cookies: These Cookies collect information about how the Users use the Platform, including which pages the Users go to most often and if they receive error messages from certain pages. These Cookies do not collect information that individually identifies a User. All information these Cookies collect is aggregated and anonymous. It is only used to improve how the Entity’s Platform functions and performs. From time to time, the Entity engage third parties to track and analyze usage and volume statistical information from individuals who visit the Platform. The Entity may also utilize “Flash” cookies for these purposes.

  • Targeting/Advertising Cookies: The Entity may engage third parties to track and analyze usage and volume statistical information from the Users who visit the Platform. The Entity may use Cookies delivered by third parties to track the performance of the Entity’s advertisements, such as Google Analytics. For example, these Cookies remember which browsers have visited the Platform. The information provided to third parties does not include Personal Information, but this information may be re-associated with personal information after the Entity receive it.

  • Analytical Cookies: These Cookies analyse how the Users navigate around the Platform (pages visited, links used etc.) or use e-mails the Entity sends to the Users. They enable the Entity to better understand the interests of the Users and to improve the Platform.

  • Third-party advertising: The Entity uses third-party service providers to display advertisements (banners or links) on the Entity’s behalf across the internet. These advertising service providers may collect information about visits to the Platform and interactions with the Services, as well as the User visits to other websites. Such information does not include User’s names, addresses, e-mail addresses but may contain Platform related information.

3. Purpose and Usage of Personal Information

3.1. All Personal Information collected is specific and utilised based on the specific Services which the User wishes to participate in or access, and is utilised for the purpose of providing such Services as requested by the User. Additionally, the Personal Information collected is utilised for the following purposes:

3.1.1. Transactions: Personal Information is used to administer accounts, process orders, send order confirmations, show Users other products that may interest them, enable successful participation in the Services etc.

3.1.2. Analytics: The Entity uses and collects Personal Information to help learn more about the Users’ preferences (to enable the personalisation of the Platform or any offers according to User interest and preference), to help address problems with and improve the Platform, to analyse trends and statistics, and to present content with the most clarity and usability.

3.1.3. Advertising: The Entity presents information to our online advertisers and brand holders to help them understand our audience and confirm the value of advertising on the Platform, it is usually in the form of aggregated statistics on the traffic to various pages within the Platform. When Users register on the Platform, the Entity may contact such Users from time to time to update User information so as to provide features which may benefit the Users.

3.1.4. Direct marketing: The Entity will only contact the Users for direct marketing purposes per emails or text message when Users have given the Entity prior consent. Users may opt-out from receiving further marketing messages at any time by sending an e-mail to care@kirajewels.com.

3.1.5. Securing the Entity’s assets: The Entity may also use Personal Information to protect the security or integrity of the Platform and the Entity’s business.

3.1.6. Legal Proceedings: In the event the Entity is required to respond to any legal proceedings, including any legal notices or court orders, User Personal Information may be disclosed pursuant to such legal proceedings in accordance with law.

4. Disclosure and Sharing of Information

4.1. The Entity treats Personal Information as strictly confidential.

4.2. The Entity may involve other companies in providing the Services to Users with whom the Entity may share User Personal Information such as third party service providers for data analytics, payments or other similar purposes. Where the Entity engages such service providers that use Personal Information, the Entity will ensure that such Personal Information is processed for specific purposes and according to the contractual terms entered into between the Entity and the Users.

4.3. Additionally, the Entity reserves the right to share, disclose and transfer User’s Personal Information collected hereunder with its affiliates or the owner of the domain under such specific contractual terms. In the event the Entity sells or transfers all or a portion of its business assets, consumer information may be one of the business assets that are shared, disclosed or transferred as part of the transaction.

4.4. The Entity may also share Personal Information where necessary to comply with any legal obligation, or in order to enforce or apply the Terms of Service or any other agreements.

4.5. Prior to the use or disclosure of Personal Information for any reasons other than as stated above, the Entity will ensure that Users are intimated of the same in a timely manner.

4.6. The Entity will take reasonable steps to ensure that all dealings in Personal Information, shall be:

  • processed lawfully, fairly and in a transparent manner;

  • obtained only with the consent of the information provider;

  • available for review by the information provider, as and when requested;

  • kept secure against unauthorized or unlawful processing and against accidental loss, destruction or damage, as per the prescribed standards;

  • collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes and

  • collected, only when:

    • the information is collected for a lawful purpose connected with a function or activity of the Entity; and

    • the collection of the sensitive personal data or information is considered necessary for that purpose.

5. Third Party Links

The Platform may also include links to third party websites. Such websites are governed by their respective privacy policies and terms of use, which are beyond the Entity’s control. Once the User leaves the Platform, use of any information provided by the User is governed by the privacy policy of the operator of the website which the User is visiting. The Entity expressly disclaims any responsibility for the privacy practices or the content of such third party websites.

6. Security Procedures

6.1. The Entity strives to ensure the security, integrity and privacy of Users’ Personal Information and to protect Personal Information against unauthorised access, use, disclosure, alteration or destruction. The Entity’s databases are stored on servers secured behind a firewall; access to such servers being password-protected and strictly limited based on a need-to-know basis.

6.2. The Entity understands that no security system is impenetrable and does not guarantee the security of its database, and as such disclaims all responsibility for any breach of security or any action of any third parties that are receiving User’s Personal Information.

7. Retention of Data

7.1. The Entity retains and continues to utilise Personal Information for as long as necessary until: (i) the relevant purposes for the use of such Personal Information pursuant to contractual arrangements are completed; or (ii) as mandated under applicable law, regulations, or legitimate business purposes.

8. Access to and Updating Personal Information

8.1. The Users may contact care@kirajewels.com in order to view and change the Personal Information provided within the Platform. The Users may also ask to erase, restrict or port their Personal Information and further intimate object, if any, to use of Users’ Personal Information by the Entity. Additionally, Users may access information the Entity holds about Users, and request a correction where data is incorrect or a deletion of the data, unless the Entity has to retain the data for legal reasons.

8.2. Users are solely responsible for the accuracy of the Personal Information provided, and for any changes, updates or modifications to such information.

9. Changes to the Privacy Policy

This Privacy Policy was posted on 17-06-2024. The Entity reserves the right to periodically review / change the Privacy Policy to incorporate such future changes as may be considered appropriate. Any material changes to the Privacy Policy will be posted on this page and where appropriate, notified to Users by e-mail. Any Users’ continued usage of the Platform after such changes constitutes their consent to such changes. Users are encouraged to check the Privacy Policy regularly so as to be aware of modifications, if any.
